Agreement

By creating an account or using Askenly you agree to these Terms. If you use Askenly for a business, you agree on behalf of that business and confirm you have authority to do so.

The service

Askenly lets you automate replies to Instagram comments, story replies and direct messages, manage conversations in an inbox, take bookings, schedule content and send email follow-ups. Features and limits depend on your plan and may change as we improve the product.

Your account

  • You must be at least 18, or the age of majority where you live, and give accurate information.
  • Keep your password secure. You are responsible for everything done in your workspace, including by team members you invite.
  • Tell us promptly if you believe your account has been accessed without permission.

Instagram and third-party services

Askenly connects to Instagram through Meta’s official API. You must have the right to connect the Instagram professional account you use, and you must follow Instagram’s Terms of Use, Community Guidelines and Meta’s Platform policies, including messaging rules such as the 24-hour reply window.

Meta can change or limit its API, permissions or your account at any time. We are not responsible for actions Meta takes, and features that depend on Instagram may change or stop working as a result.

Acceptable use

You agree not to use Askenly to:

  • send spam, unsolicited bulk messages or messages to people who have not contacted you first;
  • mislead people, impersonate anyone, or collect personal information without a lawful basis and a clear notice;
  • send illegal, harmful, hateful, sexually explicit or infringing content, or promote prohibited goods and services;
  • harass people or get around Instagram’s blocks, limits or safety features;
  • probe, overload or attack the service, bypass rate limits or plan limits, or access other customers’ data;
  • resell or rebrand the service without our written permission.

We may suspend automations or accounts that break these rules or put the service or Instagram accounts at risk.

Your content and your customers’ data

You keep all rights to the content you create and the data you bring into Askenly. You give us permission to host, process and transmit it only as needed to provide the service to you.

You are responsible for your automations’ messages and for having a lawful basis, and any notices or consents required, for the personal information of people you message, email or book. Where we process that information for you, we do so as your processor under our Privacy Policy.

AI features

AI suggested replies are drafts based on your own business information and the conversation. They can be wrong. Review every draft before you send it; you are responsible for what you send.

Plans, billing and cancellation

  • Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled.
  • You can upgrade, downgrade or cancel at any time in Settings → Billing. A cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where the law requires otherwise. Prices exclude taxes, which we add where required.
  • If a payment fails we may limit paid features until it is resolved. We will give notice before changing prices.

Free plan and changes

The free plan has the limits shown on our pricing page. We may change, add or remove features, and will give reasonable notice before removing a paid feature you rely on.

Our intellectual property

Askenly, its software, design and brand belong to us and our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Feedback you send may be used to improve the product without obligation to you.

Suspension and termination

You can stop using Askenly and delete your account at any time. We may suspend or end your access if you break these Terms, fail to pay, or if required by law or by Meta. On termination your right to use the service ends and we delete your data as described in our Privacy Policy.

Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular result, such as sales, bookings or follower growth, or that the service will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or US$100 if greater. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

You will defend and indemnify us against claims arising from your content, your automations’ messages, or your breach of these Terms or of the law.

Governing law

These Terms are governed by the laws of [COUNTRY / STATE], without regard to conflict-of-law rules. Disputes will be heard in the courts of that place, unless the law where you live gives you the right to bring a claim there.

Changes to these Terms

We may update these Terms. We will post the new version here with a new date, and give notice in the app or by email for material changes. Continuing to use the service after a change means you accept it.
